Silverado Custom Homes, Inc. is proud to provide all our customers a one-year warranty for their new home. This warranty will warrant against "covered defects" in many of the products, materials and workmanship to your home. At the closing of your home you will or have received a booklet entitled the Residential Construction Performance Guidelines. This booklet will detail items covered in our home warranty. These guidelines were created by the National Association of Homebuilders to establish an acceptable quality in residential building to satisfy both you the homeowner and the builder. Silverado Custom Homes, Inc. adheres to these guidelines and reccommend you refer to them before making a service request.
Although your home is new, it still will require routine maintenience and repair, which is your responsibility. There are many things you can and should do to prolong the life and beauty of your home and its components. Please view our Seasonal Home Maintenience section for a guide to your responsibilities as a homeowner and tips to keep your home functioning properly.
While we are very proud of your new home and feel we have delivered an excellent product, we realize your new home may need some attention. Our reputation is based on your satisfaction and our continued success is built on your referrals. If there is ever a need to address a warranted item, please give us the opportunity to do so before your warranty has expired.

1. Name and Address of Warrantor. The Name of the Warrantor (i.e. the entity making this Limited Warranty) is Silverado Custom Homes, Inc., a Michigan Corporation, whose address is P.O. Box 80214 , Rochester, MI 48308-0214 and whose phone number is (248) 841-4569.
2. Terms. The terms of the various coverage of the Limited Warranty begin on the date on which your home is deed to you, the Purchasers. The date is referred to in the Limited Warranty as the "Closing".
3. Coverage. We warrant to the original Purchaser only and will remedy any defects in workmanship for which we are notified in writing within a period of twelve (12) months from Closing, which appear in the floors, ceilings, wall and other internal structural components of your home which are not covered by other portions of this Limited Warranty. However, we shall not be obligated to make any adjustments or repairs until the unit has been occupied for a period of at least ninety (90) days subsequent of the Closing excepting in cases of emergency.
We agree to inspect the Unit at any time within one (1) year after Closing the sale upon written request by the Purchaser. Where such inspections shows defects in workmanship or materials, we will make reasonable repairs or replacement without cost to the Purchaser.
We will conduct a walkthrough with Purchaser prior to Closing. The items listed below will be repaired only if they are reported to us at that time. We will give written confirmation of repairs or warranties of the following items:
(a) Chipped, cracked or dented sinks, tubs or shower enclosures;
(b) Torn, gouged, stained or loose floor tile, vinyl or carpet;
(c) Chipped, scratched, stained or cracked cabinets, counter or vanity tops;
(d) Cracked or scratched window glass, mirrors or light fixtures;
(e) Scratched or dented water heater;
(f) Missing shelves or accessories in appliances, cabinets, medicine chests or pantries;
(g) Missing or damaged windows, doors or screens;
(h) Caulking or grouting;
(i) Trees, bushes, sod or any type of vegetation;
4. Manufacturer's warranties. We assign and pass through to you the Manufacturers' Warranties on all appliances and equipment located in your home. The following are example of such appliances or equipment on this list: refrigerator, range, dishwasher, garbage disposal, ventilating fan, air conditioner, hot water heater and furnace.
5. Exclusions from Coverage. We do not assume responsibility for any of the following which are excluded from the coverage of this Limited Warranty:
(a) Defects in all appliances and pieces of equipment, which are covered by Manufacturers' warranties. (We have assigned this Manufacturers Warranties to you and you should follow the procedures in these Warranties if defects appear in these items).
(b) Damage due to ordinary wear and tear, abusive use, neglect, modification or lack of proper maintenance of your home.
(c) Defects which are the result of characteristics common to the materials used, such as (but not limited to) warping and deflection of wood; fading, chalking and checking of paint due to sunlight; cracks due to drying and curing of concrete, stucco, plaster, bricks and masonry; drying, shrinking and cracking of caulking and weather stripping; cracks in the tile or cements and heaving of tile or cement; settlement of your home or the ground under or around the building in which of your is located or around other homes.
(d) Damage to or destruction of any tree, shrub or plant growth which is native to the home site and which remains after completion of construction of the home, regardless of Warrantor's care to protect any tree, shrub or plant growth in either its original or relocated site.
(e) Defects in items or caused by items installed or modified by you or by anyone else except us or (if requested by us) our subcontractors.
(f) Defects in the control of sound transmission.
(g) Work done by you or by anyone else except us (if requested by us) or our subcontractors.
(h) Loss or injury due to the elements.
(i) Conditions resulting from condensation on, expansion or contraction of materials.
(j) Loss or damage, which Purchaser has not taken timely action to minimize.
(k) Any existing environmental, electromagnetic or ecological conditions on the subject property.
(l) Nail pops and minor cracks in the drywall will be repaired only once during the warranty period. It is recommended that this be during the eleventh month of the warranty period. We will not be obligated to repaint or redecorate the areas repaired, said obligation resting solely with the Purchaser.
(m) CONSEQUENTIAL OR INIDENTAL DAMAGES.
6. No Other Warranties. THIS LIMITED WARRANTY IS THE ONLY WARRANTY WE GIVE, EXPRESS OR IMPLIED. IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND HABITABILITY, ARE SPECIFICALLY EXCLUDED.
7. Claims Procedure. If a defect appears which you think is covered by this Limited Warranty, you must write a letter describing it to our office at the address appearing in Paragraph 1 of this Limited Warranty. We will not assume responsibility for responding to any written letter delivered to us more than fourteen (14) days after the expiration of the one (1) year warranty period. You must tell us in your letter what times during the day you will be at home, so that we can schedule service calls appropriately. If delay will cause extra damage, telephone us. Only emergency reports will be taken by phone.
8. Repairs. Upon receipt of your written report of a defect, we will inspect your home. If a defective item is covered by this Limited Warranty, we will repair or replace it, in our sole discretion, at no charge to you within sixty (60) days after our inspection (longer if weather conditions, labor problems, or material shortages cause delays). The work will be done by us or subcontractors chosen by us.
9. Disputes. In the event the parties disagree whether any particular item is defective, the parties agree that the local Building Inspector shall inspect said item to determine, in his or her opinion, whether said item is defective and the opinion of the Inspector shall be binding upon the parties. In the event the parties disagree whether the repair or replacement of a defect is effective, the parties agree that the local Building Inspector shall inspect such corrective work to determine, in his or her opinion, whether the remedial work is satisfactory and the opinion of the Inspector shall be binding upon the parties. Where applicable, the Inspector shall refer to the workmanship guidelines found in the Residential Construction Performance Guidelines For Professional Builders and Remodelers published by the National Association of Home Builders 2000. If an item is not covered in that publication, standard industry practice shall govern.
10. Arbitration. Any dispute arising out of this Limited Warranty shall be resolved by binding arbitration conducted by the American Arbitration Association pursuant to its Construction Rules of Arbitration. Judgment upon an award rendered in such action may be sought in any court of competent jurisdiction.
11. Not transferable. This Limited Warranty is extended to you only if you are the first Purchaser of your home. When the first Purchaser sells the home or moves out of it, this Limited Warranty automatically terminates. |
